These terms and conditions govern your use of our website. Our terms have been provided and approved by legal documents provider LegalCentre. Please read the terms in full before you use this Website. If you do not accept these terms, please do not use this Website. Using the Website implies that you accept these terms. We do occasionally update these terms so please refer back to them in the future.

1.SITE ACCESS
  • 1.1 You will be able to access the majority of this Website without having to register any details with us. However, particular areas of this Website will be accessible only if you have registered.
  • 1.2 When free tests are provided, we are under no obligation to provide 'normed' scoring nor any of the additonal features which are normally available with purchased tests.
2.USE OF WEBSITE
  • 2.1 You are permitted to use our website for your own purposes. However you are not entitled to print and download any of the material provided other than the feedback reports that you will be provided after completing each test. Material on this website must not be republished online or offline without our permission.
  • 2.2 The copyright and other intellectual property rights of all material on this Website are owned by us or our licensors and must not be reproduced without our prior consent.
  • 2.3 Subject to paragraph 2.1, no part of this Website may be reproduced without our prior written permission.
3.PRIZE DRAW
  • 3.1 To enter into the prize draw, each visitor must satisfy the terms set out below:
    • (a) Individuals must be 18 or over to participate
    • (b) All entrants must register with graduatesfirst.com using the Register link and provide a valid email address that will be used to contact the winner once the prize draw has taken place
    • (c) Participants must complete at least one Numerical reasoning and one Verbal reasoning test. Completing additional tests will not lead to a double entry into the prize draw.
    • (d) Each individual may only enter once per promotional period.
    • (e) No responsibility can be accepted for entries that fail to register, are lost or not received by the promoter.
    • (f) To enter, individuals must take the tests during the period that the prize draw is running. This is currently from 01 January 2010 to 30 June 2010.
    • (g) No purchase necessary.
  • 3.2 By entering into the prize draw, all individuals will be assumed to have agreed to the sites Privacy Policy and the sites Terms & Conditions.
  • 3.3 Internet access will be required to enter. Tests must be completed online at graduatesfirst.com
  • 3.4 Answers by test takers will be analysed to identify those individuals that have taken the test properly, i.e. not answered the questions in the test randomly. These individuals will then be entered into the prize draw.
    • (a) The winner of the prize draw shall be selected at random at the end of the prize draw period.
    • (b) Graduates First Limited will inform the winner via the email address they have provided during registration, within 30 days following the end of the prize draw.
  • 3.5 The promotional prize will be an ipod Touch 64GB.
    • (a) Prizes are non-transferable.
    • (b) No cash alternative will be offered.
    • (c) Graduates First Limited reserves the right to substitute the prize for one of equal or greater value.
    • (d) The final decision remains that of graduates First Limited and the promoter is not obligated to enter into any communication.

  • 3.6 All individuals who satisfy the above terms will be entered into the prize draw.
4.SITE UPTIME
  • 4.1 We take all reasonable steps to ensure that this Website is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and, other technical issues. Therefore we will not be liable if this website is unavailable at any time.
  • 4.2 This Website may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.
5.VISITOR CONDUCT
  • 5.1 With the exception of personally identifiable information, the use of which is covered under our Privacy Policy, any material you send or post to this Website shall be considered non-proprietary and not confidential. Unless you advise to the contrary we will be free to copy, disclose, distribute, incorporate and otherwise use such material for any and all purposes.

  • 5.3 We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of Paragraph 5.2.

    • (a) The guidance provided by Graduates First Limited contains information that can be used to prepare for pre-employment assessment.
    • (b) Graduates First Limited accepts no liability for the consequences of the use of the feedback reports including any type of liability due to the contents of the report, including its subsequent use.
8.REFUNDS
  • 8.1 Refunds cannot be applied for if a test has been taken or attempted.
    • (a) Graduates First Limited will only consider refunds for tests that have experienced genuine online failures due to a Technical issue with our website.
    • (b) Any convenience refunds will not be considered.
    • (c) Our systems provide detailed information as to the behaviour of a test that is being undertaken and we will use this information to determine any refunds.
9.EXCLUSION OF LIABILITY
  • 9.1 Neither we nor any other party (whether or not involved in producing, maintaining or delivering this Website), shall be liable or responsible for any kind of loss or damage that may result to you or a third party as a result of your or their use of our website. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss, and whether in tort or contract or otherwise in connection with this Website.
  • 9.2 Nothing in these Terms shall exclude or limit liability for (i) death or personal injury caused by negligence (as defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under the law of the United Kingdom.
